These Terms govern your use of Help Is On The Way (the "App") and related services. By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Apple Acknowledgement

These Terms are between you and NKCADEV Studio only, and not with Apple. NKCADEV Studio, and not Apple, is solely responsible for the App and its content.

2. Scope of License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control, and as permitted by Apple’s usage rules. Where applicable, Family Sharing or volume purchasing may apply.

3. Maintenance and Support

NKCADEV Studio is solely responsible for maintenance and support services for the App. Apple has no obligation whatsoever to furnish maintenance or support services for the App.

4. Warranty

To the maximum extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any, under Apple’s policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

5. Product Claims

NKCADEV Studio, and not Apple, is responsible for addressing any claims relating to the App or your possession and use of the App, including product liability claims, legal or regulatory claims, and claims under consumer protection, privacy, or similar laws.

6. Intellectual Property Claims

If a third party claims that the App or your possession and use of the App infringes intellectual property rights, NKCADEV Studio, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

7. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo, are not designated by the U.S. Government as a “terrorist supporting” country, and are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms

You must comply with applicable third-party agreements when using the App, including platform rules, mobile carrier terms, and the terms for Apple Sign-In, Google Sign-In, App Store, or Google Play where relevant.

9. Third-Party Beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.

10. The Service

The App is an AI-assisted educational tool that helps with homework by analyzing submitted text, images, audio, or similar material and returning explanations, learning assistance, and practice support. The App is for educational support only.

11. Eligibility, Minors, and Parent / Guardian Accounts

The App may be used by students age 9+, but if the user is below the age at which they may lawfully manage their own account under applicable law, a parent or legal guardian must authorize and manage the account. The parent or guardian is responsible for the minor’s use of the App.

12. Accounts and User Submissions

The App may require sign-in, including Apple Sign-In or Google Sign-In. When you submit text, images, or audio, you represent that you have the right to submit that content and that doing so does not violate law or third-party rights. Avoid sending sensitive personal information unless necessary.

13. Safety Guardrails and Acceptable Use

We may reject unclear, irrelevant, unsafe, or inappropriate submissions and may suspend or terminate access for misuse, including attempts to bypass safety systems, rate limits, credits, paywalls, parental controls, school rules, or applicable law.

14. AI Outputs and Limitations

AI outputs may occasionally be incomplete, inaccurate, or inappropriate. You must verify important answers independently. The App is not a substitute for a teacher, school, or professional advice.

15. Purchases and Subscriptions

The App may offer subscriptions or digital features. On Apple devices, payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Renewal may be charged within 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings. Store rules govern billing, renewals, cancellations, and refunds.

16. Intellectual Property

The App, software, interface, branding, and content we provide are owned by NKCADEV Studio or its licensors. You receive only the limited rights expressly granted in these Terms.

17. Termination

You may stop using the App at any time. We may suspend or terminate access if you violate these Terms, create risk to the App or other users, or if required for legal, security, operational, or platform reasons.

18. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, NKCADEV Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. To the maximum extent permitted by applicable law, NKCADEV Studio’s total aggregate liability arising out of or relating to the App or service will not exceed the amount you paid for one yearly subscription to the App in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

19. Governing Law

These Terms are governed by the laws of the State of Israel, unless mandatory consumer law requires otherwise.
